Valentine’s Day is recognised as the most romantic day of the year.
Couples planning on tying the knot this year should review their Wills to consider any changes which may be necessary as a consequence of their new circumstances.
Many people are not aware that getting married or entering into a Civil Partnership automatically cancels a Will unless appropriate steps have been taken in the existing Will. As a consequence, if you have a Will, which has not taken the appropriate steps, you will have no Will at all and would die intestate. The strict Laws of Intestacy would then come into play, determining the division of your assets according to predetermined legal guidelines rather than your personal wishes.
Meanwhile it is estimated that 40 million UK adults may not have a Will in the first place. This lack of preparation can lead to confusion and distress for loved ones left behind, potentially leaving them to navigate complicated legal processes during an already challenging time. It is advised that individuals prioritise drafting a Will to avoid leaving a painful legacy for those they care about.
Greg Baker, Partner and Head of the Wills, Trusts, and Probate Department at Hegarty emphasises the importance of this issue, stating;
“Valentine’s Day may be the most romantic day of the year, but it is also the perfect time to protect your loved ones by ensuring your will is up to date.
No one likes to think too carefully about their own demise, but ensuring your final wishes are made clear and legally recognised is the perfect way to protect your loved ones from unnecessary stress after your demise.
We would encourage people, when making a Will, to use a professional, regulated solicitor to ensure your Will is valid, clear, and adequately protects those you leave behind.”
Taking the time to speak with a legal professional can provide peace of mind and ensure that all aspects of your estate are handled according to your wishes. Additionally, it can help avoid potential disputes among family members and ensure that your assets are distributed as you intend.
Moreover, it is important to regularly review and update your Will to reflect any significant life changes, such as the birth of a child, the acquisition of new assets, or changes in relationships. Keeping your Will current ensures that it aligns with your present circumstances and intentions.
So, whilst Hegarty wish you a happy Valentine's Day, we consider that as solicitors we should provide a gentle reminder of how making a will can protect your loved ones. By taking the necessary steps to secure your estate, you can provide a lasting gift of security and clarity for those who matter most in your life.
